Warranty Policy

We are committed to quality. Apex Dragon Boat warrants to the original purchaser, for one year from the date of original purchase, that the product is free from defects in material and workmanship.

This warranty does not cover the following:
• Products that have been misused or abused.
• Products that have been modified, neglected or improperly maintained.
• Normal wear of the product including damage or deterioration to the surface finish, aesthetics or appearance of the product.
• Damage caused by use of solvents, adhesives or other foreign substances applied to the product.
• Any costs incurred as a result of loss of use.
• Any incidental or consequential damages or injury.

Please contact us and provide your order number to initiate a claim under this warranty. The purchaser can send the product to the address below to obtain service:

Any postage, insurance, or shipping costs incurred in sending the product for service are the purchaser’s responsibility. If the product qualifies for the warranty, we will reimburse the costs incurred. Apex will not be responsible for products lost or damaged in shipping.

Limited Liability

APEX DRAGON BOAT’S MAXIMUM LIABILITY PURSUANT TO THIS WARRANTY POLICY, OR ANY OTHER EXPRESS OR IMPLIED WARRANTY, IS LIMITED TO THE PURCHASE PRICE YOU PAID FOR THE PRODUCT. APEX DRAGON BOAT IS NOT LIABLE FOR ANY INABILITY TO PERFORM UNDER THIS WARRANTY POLICY DUE TO EVENTS BEYOND ITS OR THEIR CONTROL, SUCH AS ACTS OF GOD, OR FOR PROPERTY DAMAGE, PERSONAL INJURY, PAIN AND SUFFERING, EMOTIONAL DISTRESS, LOSS OF REVENUE, LOSS OF PROFITS, LOSS OF BUSINESS OR ANTICIPATED SAVINGS, LOSS OF USE, LOSS OF GOODWILL, OR OTHER CONSEQUENTIAL, PUNITIVE, OR SPECIAL DAMAGES, HOWEVER CAUSED, WHETHER FOR BREACH OF WARRANTY, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, BREACH OF CONTRACT, EVEN IF FORESEEABLE, CAUSED BY A PRODUCT DEFECT, OR OTHERWISE, OTHER THAN THOSE DAMAGES WHICH ARE INCAPABLE OF LIMITATION, EXCLUSION OR RESTRICTION UNDER APPLICABLE LAW. SOME JURISDICTIONS DO NOT ALLOW LIMITATION OR EXCLUSION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATIONS OR EXCLUSIONS MAY NOT APPLY TO YOU IN WHOLE OR IN PART.

YOU EXPRESSLY UNDERSTAND AND AGREE THAT, TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, APEX DRAGON BOAT SHALL NOT BE LIABLE TO YOU UNDER ANY THEORY OF LIABILITY WHETHER CONTRACT, TORT (INCLUDING NEGLIGENCE) OR OTHERWISE FOR ANY INDIRECT, INCIDENTAL, SPECIAL CONSEQUENTIAL OR EXEMPLARY DAMAGES THAT MAY BE INCURRED BY YOU IN CONNECTION WITH THE PRODCT OR THESE TERMS, WHETHER OR NOT APEX DRAGON BOAT OR ITS REPRESENTATIVES HAVE BEEN ADVISED OF OR SHOULD HAVE BEEN AWARE OF THE POSSIBILITY OF ANY SUCH LOSSES ARISING.

IN NO EVENT SHALL APEX DRAGON BOAT BE RESPONSIBLE FOR DIRECT, INCIDENTAL OR CONSEQUENTIAL DAMAGES, INCLUDING, WITHOUT LIMITATION, DAMAGES FOR PERSONAL INJURY, PROPERTY DAMAGE, OR ECONOMIC LOSSES, WHETHER BASED ON CONTRACT, WARRANTY, NEGLIGENCE, PRODUCT LIABILITY, OR ANY OTHER THEORY.

Orders

Can I change my order?

Please contact us as soon as possible and provide your order number and a description of what needs to be changed. Your request will be put in high priority. If your order has already shipped, we are unable to make any changes.

I received the wrong item(s)

We apologize for the mistake. Please contact us as soon as possible with the following information:

• Your order number
• The missing or incorrect item(s)
• Pictures of the item(s) you received

If you live in Canada:
We will issue a return shipping label for you to use in order to avoid you incurring any additional shipping fees. Subsequently, we will send you the correct product.

If you live outside of Canada:
We will inform you of the exchange process and find a way to compensate you for any additional shipping fees you incur related to returning the item(s).

Terms of sale

Apex Dragon Boat tries to ensure that all product information and prices appearing on the website are correct at the time you place your order, however, Apex Dragon Boat is not responsible for any errors. If an error has been discovered in the price of the product you have ordered, we will inform you as soon as reasonably possible, and you will be given the option of re-confirming your order at the correct price or cancelling your order.

By placing an order for a product, you are making an offer to purchase the product from Apex Dragon Boat. After you place an order for a product, you will receive an email with your order details. Any email confirmation from Apex Dragon Boat acknowledging receipt of your order is simply an acknowledgement that your order has been received and does not indicate acceptance of your order. Please note that Apex Dragon Boat reserves the right to reject your offer to purchase the product.

Apex Dragon Boat's shipment of the product will constitute Apex Dragon Boat's acceptance of your offer to purchase the product. Any delivery dates provided by Apex Dragon Boat or a delivery agent in an email confirming shipment are estimates only and are not guaranteed.

You agree that Apex Dragon Boat will authorize the credit card, debit card, or other payment method specified by you in the amount of your order at the time the order is placed. You authorize Apex Dragon Boat to charge the credit card, debit card, or other payment method specified by you in the amount of your order at the time the order is shipped. All prices on the website are displayed in Canadian dollars. If you are making a purchase with a credit card issued in another currency, you agree that the amount charged to your credit card is subject to change due to currency fluctuations between the time you place your order and the time your credit card is charged. Apex Dragon Boat will have no liability for any claim arising from such currency fluctuations or any additional fees charged by your credit card issuer.

You agree that you will not engage in any commercial resale of Apex Dragon Boat products.

Shipping

Where do you ship to?

We only ship to Canada at this time. For other countries, please contact us for a quote.

We can ship to PO box, residential, corporate, and military addresses.

What are the shipping options?

Shipping is available by Standard or Express shipping. Tracking is included for all orders.

Canada:
Regular: 4-10 days
Express: 1-2 days

USA:
Standard: 5-10 days
Express: 2-4 days

Special promotions may include free standard shipping when your order meets the minimum subtotal (subtotal = total - discounts - gift cards - shipping – taxes).

How much does shipping cost?

The shipping fee will be provided at check-out and can be reviewed before submitting your order. We reserve the right to apply additional charges to the shipping fee after checkout for special cases i.e. shipping to remote locations. In these cases, we will notify you before shipping your order. You can choose to pay the additional charges or we can refund and cancel the order.

Shipping fees are non-refundable once your order has shipped.

Apex is not responsible for any other fees including taxes, duties, and brokerage.

Do I have to pay taxes, customs, and duties?

If you are purchasing from Canada:
A sales tax will be applied at checkout. Please verify your province’s tax on goods for more information. No customs or duties will be charged.

If you are purchasing outside of Canada:
There is no sales tax. Please verify your country’s legislation or contact your customs office for more information on customs and duties. Choosing not to pay customs fees and returning the package back to Apex means any additional shipping costs or handling fees incurred by Apex will be deducted from your refund.

Can I pick up my order?

Pick-up is not available at this time.

When will you ship my order?

Processing and shipping transit times provided at checkout are estimates. Please note, processing and shipping are two different things. If you paid for an express shipping method, your order will naturally arrive quicker than standard shipping methods once it has been picked up by the carrier.

Orders are normally processed within 2 business days. During Black Friday and the Holiday Season, this delay can be extended up to 7-10 business days. Shipping transit times begin as soon as your order leaves our facility.

Receiving an order confirmation via email detailing your purchased items does NOT guarantee all items will be in stock. We do our absolute best to ensure everything is available to ship, but due to high demand, it is possible for inventory to run out.

We will notify you by email once your order is processed and on its way. Tracking information and instructions will be provided to check your order status.

Note: Orders with multiple items of varying inventory levels may ship separately with no additional shipping charges.

Can I change my shipping address?

Please contact us as soon as possible and our Support Team will inform you if it is possible to change the address. We cannot change the delivery address once the package has been shipped.

What is the status of my order?

You will receive an email from Apex once your order is confirmed and fulfilled. Please check the status of your order using the tracking information provided in the shipping confirmation email.

Here are the possible statuses of your order:
1. Confirmed - You successfully completed the checkout process, but we have yet to ship or fulfill the order.
2. Fulfilled - The order has been packed and dispatched to the carrier.
3. Out For Delivery - Your order will be delivered soon.
4. Attempted Delivery - The carrier attempted to deliver the order to the destination address but the delivery was unsuccessful.
5. Delivered - Your order was delivered to the specified address.

I have not received my package

Please check the status of your order using the tracking information provided in the shipping confirmation email. If the status is "Delivered" but you have yet to receive it, we recommend checking your community mailbox or parcel locker as well as verify with your neighbours or concierge to see if anyone has collected the package on your behalf.

If you are unable to locate your package after 24 hours, please contact us and we will open an investigation with the courier to locate the parcel. All lost parcel claims must be made within 7 days of the delivery date.

My package was returned to sender

Your package may have been returned to Apex for the following reasons:
• Package was not picked up
• Incorrect address was provided
• Other delivery issues

We will email you as soon as we receive your package. The purchaser is responsible for any additional shipping charges to re-collect the package.

Returns & Exchanges

Can I refund or exchange my order?

If within 60 days of the date of shipment of your product, you are dissatisfied for any reason, you may return it for refund, exchange, or credit in accordance with the following requirements:
• Product is unused, unaltered, and shows no signs of use
• Proof-of-purchase is provided

Original shipping, handling, and other charges accrued at time of original purchase will not be refunded.

Exchanges can be made for item(s) of equal or lesser value.

The following items are final sale and do not qualify for a refund or exchange:
• Undergarments, bottles, stickers, gift cards

The following items do not qualify for a refund but may be exchanged:
• Custom-configured products
• Discounted and clearance products
• Second-hand products
• Refurbished products

How do I refund or exchange my order?

Please contact us and provide the following information:
• Your name, email, and phone number
• Order number
• Reason for return/exchange
• Quantity, product name(s), size, and colour being returned/exchanged
• Quantity, product name(s), size, and colour for exchange

Once we receive the request, our Returns Team will email you an identification number to be included with your return. The product can be sent to:

Any shipping, insurance, and brokerage costs incurred in returning the product are the purchaser’s responsibility. We recommend using the most affordable shipping option. For exchanges, Apex will cover the cost of shipping items back to you.

Apex will not be responsible for products lost or damaged in shipping.

Upon receipt of the returned product, Apex will inspect and determine if the product qualifies for refund or exchange. You will be notified within three business days by email of the options available to you.

I received a damaged item

We apologize for the inconvenience. Please contact us within 7 days of receiving the product with the following information:
• Your order number
• Damaged item name
• Photo(s)/video(s) showing:
1. Damage on the item as clearly as possible
2. Full-length item
3. Damage to package if applicable
